Terms and Conditions

Most of my jewelry is made to order., although I do try to keep a small supply of the most popular charms in hand.  Metal clay pieces usually take four or five days, cast pieces one to two weeks. Stone setting and other custom design may take a little longer.  Please read the design listing carefully to find out what to expect for the piece you’re interested in.  If in doubt, just ask!  And if I’m on the road or the item is back ordered, I’ll let you know by e-mail.

I ship via the US Postal Service unless you ask for other arrangements.  Our default shipping is First Class Parcel in a padded envelope, which takes two to five days.  If you want another option, such as Express Mail, let me know.  I can send you a PayPal invoice for the balance.

International orders are usually shipped International First Class Large Envelope, but you have the option of choosing faster methods, right up to International Express. with the appropriate customs forms. Please don’t ask me to mark items as gifts. I ship often enough to Canada and Europe that this could come back and bite both of us.

If you’re not delighted with your purchase, send it back in it’s original packaging within 30 days, and let me know whether you want an exchange or a refund.  If you got a piece of my jewelry as a gift, you’re welcome to exchange it for something that suits you better.  Just be sure it gets back safely, and tell me what design you’d prefer.

Your credit card payment is processed through Etsy Payments, one of the most secure payment portals out there, and I don’t have access to your card number or other payment details.

The short version: your e-mail, other contact details, and order details are held on a secure server and won’t be shared with anyone.   I use the information to fulfill my recrd-keeping obligations to my sales platforms and payment gateways, and to improve my business practices.

The long version is the mandatory EU-compliant policy, which is this:

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or its related sites and services.

This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.

To fulfil your order, you must provide me with certain information (which you authorized Etsy to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. (Please note that Etsy and PayPal do not share your credit card details with sellers.)

You may also choose to provide me with additional personal information (for a custom order of jewelry or sculpture, for example.)

I rely on a number of legal bases to collect, use, and share your information, including:

1) as needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support; 2) when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list; 3) if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and 4) as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as (a) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and (b) Compliance with the Etsy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use. *If you contacts me to access, correct or delete personal information held by Etsy, I may contact Etsy at Etsy.com/help for assistance, or request that you send your request directly to Etsy.

I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.

I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

I retain your personal information only for as long as necessary to provide you with my services and as described in this Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for four years, except when you have affirmatively subscribed to a newsletter or other form of updates from me.

I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.

You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

For purposes of EU data protection law, I, Elizabeth Trail, am the data controller of your personal information.
